AdsJockey is an advertising marketplace operated by Zane Marketing ("AdsJockey", "we", "us" or "our") that lets advertisers and agencies discover, plan and book verified advertising inventory across digital, cinema, and hyperlocal and BTL media. These Terms of Service ("Terms") govern your access to and use of https://adsjockey.com, the AdsJockey platform and all related services.
By creating an account, requesting a media plan, or booking any inventory, you agree to these Terms. If you do not agree, do not use the platform.
2. Eligibility and accounts
The platform is intended for businesses, agencies and their authorised representatives. It is not for consumers or anyone under 18 years of age. You must provide accurate, current and complete company and contact information and keep your login credentials secure. You are responsible for all activity under your account.
One legal entity per account. An agency may manage multiple client workspaces under a single agency account and remains responsible for each client's campaigns. We may verify your identity and business details, and may refuse, suspend or close any account that provides false information, misrepresents inventory ownership or booking intent, or breaches these Terms.
3. How the marketplace works
AdsJockey is a managed marketplace. We list and help verify advertising inventory offered by media owners, publishers and platforms ("Media Partners"), present published and indicative rates, and facilitate planning, booking, campaign set-up and reporting between advertisers and Media Partners.
We act as an intermediary and facilitator. We are not the owner of the media inventory unless expressly stated. Media Partners remain solely responsible for the inventory they make available, including its legality, availability, quality and delivery.
4. Listings, rates and taxes
Rates shown on listings are indicative and are provided to help you plan.
- All rates are exclusive of taxes. Goods and Services Tax (GST) at the applicable rate, currently 18%, and any other statutory levies are charged in addition.
- Formats are sold on models such as CPM, CPC, CPV, per unit, per send, per day, packages or flat fees, and many carry a minimum billing value stated on the listing.
- Final rates, inventory availability, targeting, schedule and creative specifications are confirmed on the rate card by the AdsJockey team before your campaign goes live. Until we confirm in writing, no rate, discount or availability is guaranteed.
- Where a listing shows reach, audience, demographics or performance data, these are indicative figures drawn from the Media Partner or credible sources and are not a promise of delivery.
5. Media plans, bookings and confirmation
Adding inventory to a plan or submitting a request is an expression of interest, not a confirmed booking. A booking becomes binding only when we have confirmed final rates, targeting and schedule, you have accepted them, and payment, or an approved purchase order or credit arrangement, is in place.
We reserve the right to decline or cancel any request before confirmation, including where inventory is no longer available or the creative does not meet guidelines or applicable law.
6. Payment
Unless a written credit arrangement is agreed, campaigns are prepaid and inventory is reserved only against cleared payment. Invoices are raised in Indian Rupees and are payable by the due date stated. You are responsible for all taxes other than taxes on our income.
Late payments may lead to suspension of live campaigns and interest at the rate permitted by law. Production, creative, printing and any third-party or platform pass-through costs are billed in addition to media and are itemised where applicable.
7. Creative approval and campaign guidelines
You are responsible for supplying creative that meets the format specifications, file types, sizes and campaign guidelines published on each listing, along with landing pages, brand assets and any approvals or disclaimers required by law.
All creative is subject to review and to Media Partner and platform approval, which may be refused or withdrawn. Creative changes after submission typically take 1 to 2 working days to process and may affect the schedule.
8. Delivery, lead times and turnaround
Standard lead time to launch is about 3 working days after all creative, targeting, approvals and payment are in place, unless the listing states otherwise. Stated turnaround times exclude Saturdays, Sundays, public and regional holidays, and any delay caused by events beyond our reasonable control or by incomplete or late inputs from you.
Schedules, go-live dates and delivery are estimates and may be affected by Media Partner availability, platform behaviour and inventory demand.
9. Proof of execution and reporting
After go-live we share a delivery or proof of execution report covering impressions, reach and the key metrics agreed for the campaign.
- Screenshots are provided for direct campaigns where available and are not provided for programmatic campaigns.
- For offline, in-store, on-bus and other physical formats, photographs of the live activity are shared as proof.
- One-time sends such as SMS, WhatsApp, push and email are dispatched once and cannot be recalled or reissued after sending; proof of dispatch is provided.
- Reporting cadence is confirmed at onboarding.
10. Advertiser responsibilities and content standards
You are solely responsible for your creative, claims, landing pages and the products or services you advertise, and you warrant that they comply with all applicable laws and codes, including the Advertising Standards Council of India (ASCI) Code.
- You must not advertise categories that are prohibited or restricted by law or by the relevant Media Partner or platform, including tobacco, gutka and surrogate advertising, illegal or counterfeit goods, and any content that is misleading, defamatory, obscene, or infringes third-party rights.
- You must hold all licences, consents and rights needed for your creative, trademarks, music and other assets.
- We and our Media Partners may reject or remove any creative or campaign that breaches this clause or applicable guidelines, without refund of amounts attributable to the breach.
11. Media Partner responsibilities
Media Partners are responsible for the accuracy of their listings, for holding the rights to the inventory, and for delivering booked campaigns as confirmed. AdsJockey verifies listings on a reasonable-efforts basis but does not independently guarantee every detail of Media Partner inventory.
12. Changes, pauses and cancellations
Once a booking is confirmed, changes, pauses and cancellations are subject to the timelines on the listing, Media Partner and platform rules, and our Refund Policy. Some formats, including one-time sends and campaigns already live or in production, cannot be paused, changed or cancelled. Requests must be made in writing to support@zane.marketing.
13. Refunds
Refunds, where applicable, are governed by our Refund Policy, which forms part of these Terms. In summary, confirmed campaigns that are live, dispatched or in production are generally non-refundable, and verified under-delivery is addressed by a make-good or pro-rata credit before any cash refund is considered.
14. Intellectual property
The AdsJockey platform, brand, logos and all associated content are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the platform for its intended purpose.
You grant us and the relevant Media Partners a licence to host, reproduce, distribute and display your creative solely to deliver and report on your campaigns, and to use campaign performance data in aggregated, anonymised form to operate and improve the platform.
15. Third-party platforms and trademarks
Listings may reference third-party platforms, apps and brands. All third-party names, logos and trademarks belong to their respective owners and are used for identification only. Their inclusion does not imply endorsement, partnership or affiliation beyond the specific inventory made available, and your campaigns on those platforms are also subject to the platform's own policies.
16. No guarantee of results
We do not warrant any specific business outcome, sales, clicks, conversions, footfall or return on investment. Audience, reach and performance figures are estimates. To the maximum extent permitted by law, the platform and all inventory are provided on an "as available" basis.
17. Limitation of liability
To the maximum extent permitted by law, AdsJockey and Zane Marketing are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, goodwill, data or business, arising from your use of the platform or any campaign. Our total aggregate liability for any and all claims arising from your use of the platform or any campaign is limited to ten thousand Indian Rupees (Rs 10,000).
18. Indemnity
You agree to indemnify and hold harmless AdsJockey, Zane Marketing, our Media Partners and our respective officers and employees from any claim, loss, liability, cost or expense, including reasonable legal fees, arising from your creative, your advertised products or services, your breach of these Terms, or your infringement of any law or third-party right.
19. Suspension and termination
We may suspend or terminate your access, or any campaign, immediately if you breach these Terms, fail to pay, provide false information, or use the platform unlawfully. You may close your account at any time, subject to settlement of amounts due and completion of live bookings.
20. Confidentiality
Rates, rate cards, plans and any non-public information shared through the platform are confidential and must not be disclosed to third parties or used other than to plan and run your campaigns, except as required by law.
21. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of god, natural disasters, strikes, outages, platform or network failures, changes in law, or government action.
22. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any applicable arbitration or consumer law, the courts at Gurugram, Haryana have exclusive jurisdiction over any dispute arising from these Terms or your use of the platform.
23. Changes to these Terms
We may update these Terms from time to time. The current version is always available at https://adsjockey.com/legal/terms, and material changes take effect when posted. Your continued use of the platform after a change means you accept the updated Terms.
